Graphic Design & Printing.
At Pynk Dynamite, we work closely with your Intellectual Property (IP) lawyer to ensure that your logo design is distinctive and surpasses the generic standard set by the USPTO. Our goal is to help you create a logo that is eligible for trademark registration. However, please note the following:
- Trademark Filing: It is the responsibility of the customer to engage an IP lawyer to conduct a trademark search, identify the relevant international class for the trademark claims, draft the claims, and file the application with the USPTO, including submitting the specimen. Pynk Dynamite does not provide legal services and is not responsible for the legal aspects of filing or defending the trademark.
- Copyrights: After completing the design and working with your IP lawyer, we will bring your ideas to life and provide you with the original artwork. The customer is solely responsible for filing copyrights for the work and any related claims.
- Image Use and Copyright: Pynk Dynamite is not responsible for any copyright claims related to images created from or based on third-party materials provided by the customer. If the customer provides images as a reference or starting point for design, it is the customer's responsibility to ensure those images are not infringing upon existing copyrights.
- Indemnification for Printing: You agree to indemnify and hold harmless WAXYIIZ LLC, DBA Pynk Dynamite, and all affiliates from any and all losses, costs, expenses, and damages arising from any claims, demands, actions, or proceedings that may be instituted against us, alleging that the printing of materials (such as logos, designs, or other artwork) violates any copyright or proprietary rights of any third party.
- Certification of Ownership: You certify that you own the rights to use the image(s) being reproduced in your order. By submitting any images for printing or design, you confirm that these images do not infringe on any copyright or proprietary rights of any third party.
By agreeing to proceed with Pynk Dynamite’s graphic design and printing services, the customer acknowledges and accepts these terms.
